The following are the key points made during Goodman’s Friday presentation, and are in note form. If any clarification is needed, contact Mark at SPLC.

What’s happening now relating to student media?

More cases are currently going to court than in the last 15 to 20 years. This seems to be on the rise as more school administrations are cracking down on student press than ever before.

Important court case decided in April 2003:

Fed Appeals Court 7th Circuit – Governors State College, Illinois. An administrator insisted on prior to review, and told the printer not to allow the paper to go to press unless administrators had reviewed it first. The students went to the court and the court said that administrators can not censor student-run publications. The court stated that Hazelwood does not apply to college publications. Protection was affirmed for college publications. The First Amendment still has some vitality in public schools despite Hazelwood.
Legally, schools can engage in prior review, unless there are specific laws prohibiting review. California is one state where there are laws allowing for free student speech.

The Dade County Fla. school board has a policy that prohibits administrators from conducting prior review.

Across the nation there are growing threats to advisers for their support of free student speech. Advisers are being told that their jobs are on the line. An adviser was told that she would be fired if she heard any students talking about illicit sex or drug use without reporting it to administrators. No other teacher was given this ultimatum.

If student publications use school facilities, then there is implicit control.

Positive and interesting developments:

Case: Wooster High School in Ohio
A group of students were caught drinking at a publication party off school property. One member of the party was the daughter of a school board member. The penalty she received was not as great as the others. The paper covered the story and the administration censored it.
Preliminary ruling: The paper had a clear policy as public forum with a history of students having control over content, thus a higher level of protection. The judge said, “The publication is a forum.” The case is in early stages and will go forward.
Case: Utica High School in Michigan.
Community members had sued the school because bus fumes had caused a health threat. The school paper wrote about it. The administration censored the paper. Clearly censorship was wrong, and this is upheld legally.

It is important for student publications to have clear policies in place.

Limited public forum

People have the right to express themselves, but are limited to designated group of people—limited to students who are in the class.

School policy should be explicit – first and foremost. This can be enough to establish public forum.

Publish the phrase “This is a forum for student expression. Students make the editorial decisions regarding content.”

The clearer the policies are, the less likely there will be conflicts.

Schools that don’t censor will be protected from legal liability. Administrators should understand this.

“Principals Guide to Scholastic Journalism” published by Quill and Scroll is a good resource for advisers.

Private schools are not public agencies so The First Amendment does not traditionally apply. Private schools can adopt policies that provide free expression.

State of California has a law protecting private schools from being punished for free expression. The Leonard Law in California applies.

Cannot prevent distribution of survey as long as it is being done by students and not by any school officials.

Student questions about individual cases.

Title Nine requires equal opportunities between male and female in schools. First Amendment trumps Title Nine.

Cases involving independent student publications – leaflets, websites, underground newspapers.
Can schools punish students? No. School can’t punish for private expression. No legal grounds.

Cases going to court

Student expression that is religious in nature. Schools are censoring, but courts are saying that religious expression is just as protected as non-religious expression.

As long as school officials aren’t making the content decisions, then students can write about religious topics.

Access to public records. Each of the 50 states have open records laws. Even private schools have to provide copy of annual tax return. Schools can be fined $1000 a day for withholding this information. Students have the right to access records that aren’t private information.

Keynote Speech from Tim Harrower

When your adviser says keynote speaker, a list of adjectives and conclusions are immediately drawn from your head- intriguing not being one of them. Tim Harrower, on the other hand, proved student journalists wrong.

"He was funny. Of all the JEA conferences I've been to, he was the best one yet and the bingo was a nice touch," said Julie Clark, senior from Pleasant Valley High School in Chico, Calif.

Instead of the traditional droning, Harrower created a game of bingo using key phrases from his presentation. With an audience of over 2000, Harrower took the edgier approach that all in all seemed to be his key.
